TERMS AND CONDITIONS

Welcome to van Vuuren Photography. Please read these terms and conditions carefully before making any purchase. By accessing or using the services provided by Timothy John Jansen Van Vuuren, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you may not access the service.

1. Products and Services: Timothy John Jansen Van Vuuren offers a variety of high-quality prints of original photographs for purchase by customers worldwide. All products are subject to availability.
2. Ordering: To place an order, customers must provide accurate and complete information. I reserve the right to refuse or cancel any order at any time for reasons including but not limited to product availability, inaccuracies, or errors in pricing or product information.
3. Shipping: I strive to deliver orders in a timely manner. However, please note that delivery times may vary depending on the destination. Customers are responsible for any customs duties and taxes that may apply to their orders when they arrive in their destination country.
4. Payment:  All prices are listed in USD, but most currencies are accepted. I accept various payment methods, including but not limited to credit/debit cards and PayPal. Proof of Payment documents are not accepted as confirmation of payment. Full payment is required, and the total amount must be reflected in my bank account before the printing and delivery process commences. 
5. Returns and Refunds: I want you to be completely satisfied with your purchase. If for any reason you are not satisfied, please contact me within 2 days (48 hours) of receiving your order for assistance. Please note that certain conditions apply for returns and refunds. Please see below in detail under the heading RETURN AND REFUND POLICY.
6. Copyright and Use: All printed photographs sold by Timothy John Jansen Van Vuuren are protected by copyright. The purchase of any product does not provide the buyer with the copyright or any reproduction rights of the images in any way whatsover. Customers may not reproduce, distribute, redistribute or sell the photographs without prior written permission from Timothy John Jansen Van Vuuren.  Customers purchasing prints of photographs taken by Timothy John Jansen Van Vuuren acknowledge that they are entitled solely to the physical printed photograph that they purchase and receive. No rights to the RAW or digital images and fomats associated with the photographs are transferred or included in the purchase. All rights and ownership to the RAW and/or any digital formats of the images remain the sole property of Timothy John Jansen Van Vuuren. 
7. Limitation of Liability: Timothy John Jansen Van Vuuren shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9. Prices: Please note all prices quoted/indicated are non negotiable. They are exclusive of shipping costs. Shipping costs vary depending on region and will be calculated accordingly to each specific order placed and included thereafter in the invoice. Prices are inclusive of actual processing and printing of the image onto Hahnemühle papers.
10. Import Tax/GST/VAT: We use DDU declaration process. Delivered At Place (DAP). Also called delivered duty unpaid (DDU). This term indicates that the seller only takes responsibility for organising the logisitics of shipping the product, and requires the customer to pay any import costs, such as VAT/GST/Import taxes, duties, and clearing fees. The recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders shipped outside of South Africa or Australia (Depending on where the print is developed & shipped from at the time of order due to the artists location) may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the recipient's country. Additional charges for customs clearance must be fulfilled by the recipient. Our company has no control over these charges, nor can we predict what they may be. Customs policies vary widely from country to country. You can contact your local customs office for more information. VAT (Value added tax) / GST (General Sales Tax) is not included in product price thereby preventing double taxation, since the importing country will charge their own taxes.
11. Framing: We do not do framing for domestic or international deliveries as many countries have strict substance entry protocols. eg. Australia has stringent rules in place for wooden products entering the country. Furthermore we do not do framing for domestic & international prints as it increases the chances of damage to the print as well as shipment pricing. Prints are sent rolled up in a hard tube for protection and it will be up to the buyer of the print to frame the print. Another consideration is that frames increase shipping costs due to size and weight.
12. Please note that pricing remains consistent regardless of the chosen print size. Our prices are determined by the photograph itself, the effort, skill and personal investment undergone in taking the photograph and the artistic expression, allowing you the flexibility to select your preferred size if you choose to customise your size. 
13.  Please note that each print will feature a white border, which is included to accommodate the designated size of the paper upon which the photograph will be printed. Due to post-processing crop factors, the photograph will not precisely match the dimensions of the designated size of the dimensions given on the website. This white border serves to facilitate framing and ensures that the original photograph fits appropriately on the paper medium, preventing any distortion of the image during the printing process.
14. Governing Law: These terms and conditions are governed by and construed in accordance with the laws of South Africa, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

Intellectual Property Notice

By purchasing a print from me, you acknowledge that the photograph remains the intellectual property of the artist (Timothy John Jansen Van Vuuren). Your purchase grants you ownership of the physical print that you receive only and does not include any rights to reproduce, distribute, redistribute or create derivative works from the photograph. Any unauthorized reproduction or use of the image is strictly prohibited and will be subject to legal action.

Timothy John Jansen Van Vuuren reserves the right to modify or replace these terms and conditions at any time without notice.
